Why this matters now

In May 2026 the Supreme Court ruled — unanimously — that brokers can be sued for negligently hiring unsafe carriers (Montgomery v. Caribe Transport II). Vetting carriers is now a legal duty. But for most carriers there is nothing to vet — so good operators get lumped in with complete unknowns.

The gap

Missing data isn't unsafe. It's invisible.

FMCSA treats zero-inspection carriers as "insufficient data," not high-risk. But to a broker, a careful operator with no record looks identical to a complete unknown. There's nothing to point to.
